EVOLVE’S MEGA PRIZE BONANZA TERMS & CONDITIONS
Terms and Conditions
1. The promoter is Evolve Mixed Martial Arts (“EVOLVE”) whose registered office is at 26 China Street, Far East Square, #01-01, Singapore 049568.
2. These terms and conditions (“Terms and Conditions”) shall apply to the “EVOLVE’s Mega Prize Bonanza” (“Lucky Draw”) organized by EVOLVE.
3. By registering or taking part in this Lucky Draw, you agree to be bound by these Lucky Draw Terms and Conditions and the decisions of EVOLVE in relation to and in connection with this Lucky Draw.
Qualifying Period
4. The Lucky Draw is from 0600 hrs, 1 April 2024 to 2300 hrs, 7 June 2024 (both dates inclusive) (“Lucky Draw Period”).
5. EVOLVE reserves the right to change the Lucky Draw Period.
Eligibility
6. You must be 18 years and above (as of the start of the Lucky Draw Period) and be a Singapore citizen, Singapore permanent resident or Singapore resident (with a valid employment pass or work permit) to participate in the Lucky Draw (“Participant(s)”).
7. The following categories of people are not eligible to participate in the Lucky Draw:
a) All permanent and/or contract employees (“Employees”) of the EVOLVE Group of Companies and their immediate family members (i.e. spouses, children, parents, brothers, and sisters) (“Immediate Family Members”).
b) All agencies and/or service providers engaged by EVOLVE (including but not limited to advertising agencies, promotions agencies, printing companies, event management agencies, and any persons assisting or who are involved in the Lucky Draw) and their Employees and Immediate Family Members.
c) All dealers and/or distributors of the products of the EVOLVE Group of Companies and their Employees and Immediate Family Members.
8. EVOLVE has the absolute discretion to determine the eligibility of Participants. Such determination shall be final and conclusive and EVOLVE is not obliged to give any reason for its determination.
Allocation and Usage of Lucky Draw Coupons
9. Participants will be given a Lucky Draw Coupon (“Coupon”) based on the following:
a) (1) Lucky Draw Coupon with every new Prepaid Plan or Installment Payment Plan membership purchase within the Lucky Draw Period;
b) (only applicable for existing EVOLVE members) (1) Lucky Draw Coupon with every renewal Prepaid Plan or Installment Payment Plan membership purchase within the Lucky Draw Period;
c) (1) Lucky Draw Coupon with every select TEAP package purchase within the Lucky Draw Period;
d) (only applicable for existing EVOLVE members) (2) Lucky Draw Coupons with every successful new membership referral of a new Prepaid Plan or Installment Payment Plan membership purchase within the Lucky Draw Period.
10. Only original Lucky Draw Coupons are valid for participation in the Lucky Draw.
11. To be eligible for the Lucky Draw, you must:
a) provide complete, legible, accurate, and valid information as required in the Coupon;
b) present the original receipt (“Receipt”) for your purchase upon collection of the Coupon;
c) deposit the Coupon in the designated box located at our Front Desks.
12. EVOLVE has absolute discretion to disqualify any Lucky Draw Coupon that does not meet the criteria set out in these Terms and Conditions. Such determination is final and conclusive and EVOLVE is not obliged to give any reason for its determination.
Prizes
13. There will be five (5) Lucky Draw winners for each EVOLVE location (Far East Square, Orchard Central, KINEX, and Star Vista).
14. The winners for the Lucky Draw (“Winners”) will be drawn at random at 1000 hrs on 8 June 2024 (“Draw Date”) at the respective EVOLVE locations:
a) Far East Square: 26 China Street, Far East Square, #01-01, Singapore 049568
b) Orchard Central: 181 Orchard Road, #06-01, Orchard Central, Singapore 238896
c) KINEX: 11 Tanjong Katong Road, #02-52, KINEX, Singapore 437157
d) Star Vista: 1 Vista Exchange Green, #02-26A, The Star Vista, Singapore 138617
15. One winner will receive one prize respectively with no exchange entertained:
- 1st prize: Two economy class tickets to Tokyo and four nights stay at a five-star hotel in Tokyo (one (1) room only with a maximum of two (2) guests per room).
- 2nd prize: Two economy class tickets to Seoul and four nights stay at a five-star hotel in Seoul (one (1) room only with a maximum of two (2) guests per room).
- 3rd prize: Two tickets to a 3 Days 2 Nights Royal Caribbean Cruise trip.
- 4th prize: 12-month EVOLVE Black Card Membership.
- 5th prize: 6-month EVOLVE Black Card Membership.
16. All flights, cruise, and hotel bookings are subject to availability. In addition:
a) The prizes are only applicable for the following travel months: July, September, and October 2024 for the 1st and 2nd prize, and December 2024 to February 2025 (subject to Cruise schedule) for the 3rd prize;
b) The winner will need to inform EVOLVE of the preferred travel dates within seven (7) calendar days of being notified;
c) If the prize includes a ticket for a companion, both the winner and the companion must travel together for the entire trip;
d) Upgrades are not permitted;
e) Changes are not permitted once tickets have been issued;
f) The prize does not include land transport (including travel to and from the airport), additional tours and ground arrangements, hotel incidentals, meals, and all other activities and expenses. Any further incidentals/expenses incurred must be covered by the winner.
17. All Winners shall be notified by phone at their phone number as indicated in the Lucky Draw Coupon within seven (7) calendar days of the Draw Date.
18. EVOLVE will agree with the Winner on a date to redeem the Prize. Personal identification documents (e.g. NRIC or passport) with details matching the Participant’s personal identification details in the winning Lucky Draw Coupon must be presented to the authorized EVOLVE representative at the respective EVOLVE locations. If a Winner fails to produce the required personal identification documents, his/her respective prize will be forfeited (without any liability on the part of EVOLVE to any person).
19. Prizes that are not redeemed within seven (7) calendar days from the Draw Date will be forfeited. No correspondence or claims will be entertained in the event of such forfeiture. A Participant whose prize has been forfeited shall not be entitled to any payment or compensation whatsoever from EVOLVE.
20. Reserve winner(s) will be drawn to replace any winner(s) subsequently disqualified.
21. EVOLVE may forfeit the prize, or if already awarded, reclaim the prize at the expense of the winner without compensation if, in EVOLVE’s sole and absolute determination, the winner is not eligible or is disqualified for whatever reason.
22. Prizes are not transferable or exchangeable for cash, credits, or any other item or otherwise, either partially or wholly. Use of the Prizes shall be subject to EVOLVE’s terms and conditions.
23. EVOLVE reserves the right to, at any time and in its sole and absolute discretion, replace and/or substitute any of the Prize(s) with any other item of a similar value.
24. EVOLVE will endeavor to hold the Lucky Draw on and at the advertised date, time, and venue and in the manner advertised but reserves the right to conduct the Lucky Draw in such manner as it deems fit in its absolute discretion. EVOLVE reserves the right to void, cancel, suspend, or amend the Lucky Draw in its absolute discretion without any notice and/or liability to any party.
Personal Information
25. By participating in the Lucky Draw, the Participants (including the Winners) are deemed to have consented to:
a) the collection, use, and disclosure of his/her name, identification/passport number, image, voice and/or likeness by the EVOLVE Group of Companies for editorial, advertising, promotional, marketing and/or other purposes without any payment and/or compensation except where prohibited by law; and
b) receiving promotional, marketing, and other publicity information from EVOLVE from time to time.
26. EVOLVE has commercially reasonable safeguards and measures to ensure that information and data remain secure, but no security measures are infallible and EVOLVE does not warrant, represent, or undertake in any way that your personal data and/or communications will always remain private and safe. To the fullest extent permitted by law, EVOLVE shall have no liability directly or indirectly arising out of or in connection with any loss, theft, unauthorized access, collection use, disclosure, copy, modification, or other action relating to any personal data held by EVOLVE.
27. EVOLVE reserves the right to engage authorized photographers and videographers to take photographs and/or video recordings. By participating in the Lucky Draw, Participants consent to be photographed and recorded by authorized photographers and videographers and consent to EVOLVE’s use of such images, films, or recordings for creating marketing and publicity materials for public transmission.
General
28. The decisions of EVOLVE on all matters relating to or in connection with the Lucky Draw are final, conclusive, and binding. EVOLVE shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Lucky Draw.
29. EVOLVE reserves the right at any time in its sole and absolute discretion to determine and/or amend or vary these terms and conditions without prior notice, including but not limited to canceling, extending, terminating, or suspending this Lucky Draw, the eligibility terms and criteria, the selection and number of winners, and the timing of any act to be done, and all Participants shall be bound by these amendments.
30. EVOLVE shall not be responsible for any injury, loss, or damage suffered as a result of, or in connection with the Lucky Draw and/or redemption or use of the Prizes howsoever arising, including but not limited to, fulfillment of the prize(s), any error in computing chances, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise. For the avoidance of doubt, cancellation, termination, or suspension by EVOLVE of this Lucky Draw shall not entitle any party to any claim or compensation against EVOLVE for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
31. In the event of any inconsistency between these Terms and Conditions and any advertising, promotional, publicity, and other materials relating to or in connection with the Lucky Draw, these Terms and Conditions shall prevail.
32. The Lucky Draw and these Terms and Conditions shall be governed by the laws of the Republic of Singapore and all Participants (including the Winners) are deemed to have agreed to submit to the exclusive jurisdiction of the Singapore Courts.
33. A person who is not a party to any agreement governed by these terms and conditions shall have no rights under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any terms of such agreement.
